Privacy Policy

This Privacy Notice is effective as of the day of publication: 1/22/2024

1. Introduction

CTAboi LLC, Website Series is a service that assists reporting companies when filing Beneficial Ownership Information Reports (“BOIR”) with FinCEN. This Privacy Notice covers what personal information we collect, how we collect it, and how we use it. Please refer back to this notice as it may be updated. 

2. Applicability

This Privacy Notice applies to your use of the website and services found at www.ctaboi.com (“website”). It also covers information we collect about you when engaging over chat, email, or phone. This Privacy Notice applies to you or anyone using this site or our services (“users”). 

3. Notice to Minors

The Corporate Transparency Act expressly exempts minors from reporting. This website is not intended for individuals under the age of eighteen (18) (“minors”). No personally identifiable information (“PII”) should be provided for minors. We do not knowingly collect information for minors, nor should you submit any information for minors. If you are a minor do not use our site or our services.  When a parent or guardian for a minor is listed as a beneficial owner we may require information when the minor turns 18 since BOIR will need to be updated within thirty (30) calendar days of such birthdate. While we are not obligated to notify you of the need to update your filing, we may in the future provide that as a courtesy reminder.

If you inform us that we have collected or received beneficial ownership information from a minor you may request that the minor’s information other than name and birthdate be deleted. 

4. Information we collect

In order to assist with BOIR filings we may collect personally identifiable information including:

  1. Full legal names
  2. Job titles
  3. Dates of birth
  4. Residential Mailing addresses
  5. Identification numbers including:
    1. State driver’s license numbers
    2. Passport numbers
    3. Tax identification numbers
  6. Biometric information in the form of images of faces from identification documents
  7. Expiration dates for government issued identification cards
  8. Financial information such as
    1. Ownership and control of entities
    2. Credit card information or other payment method information
    3. Billing addresses
    4. Order history
  9. Email addresses
  10. Phone numbers, including cell phone numbers
  11. IP Addresses

We may also collect information that may be used anonymously or in conjunction with other PII such as:

  1. Browsing behavior such as
    1. Time spent on pages
    2. Clicks
    3. Heatmaps
  2. IP Addresses
  3. Geolocational data
  4. Device information
  5. Traffic sources

Other non-personal, but potentially sensitive information we collect includes:

  1. Entity names
    1. Including “doing business as” (“DBA”), trade names, and domain names
  2. Tax identification numbers
  3. Business mailing addresses and physical office locations
  4. Number of full time employees in the United States
  5. State of incorporation
  6. Previous tax year’s gross income

5. How information is collected

We collect information through several different means:

  1. When users submit data on our site for BOIR
  2. When users place orders
  3. Through phone, email, and chat
  4. Through cookies and similar technologies
  5. From our affiliates, specifically Agents and Corporations, Inc. also known as “IncNow

Third party vendors, including Google, use cookies to serve ads based on a user’s prior visits to your website or other websites. Google’s use of advertising cookies enables it and its partners to serve ads to your users based on their visit to your sites and/or other sites on the Internet.

Users may opt out of personalized advertising by visiting Ads Settings. (Alternatively, you can direct users to opt out of a third-party vendor’s use of cookies for personalized advertising by visiting www.aboutads.info.)

6. How information is used and stored

Information collected for the purposes of filing a BOIR will primarily be to make, update, or correct BOIR report filings. Some of the other information we collect may be stored and used for other purposes. 

Generally, our team may access and use your information in order to

  1. Provide services
  2. Process orders
  3. Improve our services
  4. Respond to questions
  5. Comply with government regulations
  6. Market our services and complementary services to you

We may text or call your cell phone number for the purposes of providing notices, updates, and reminders to all beneficial owners obligated to keep the BOIR updated and to use for existing requests for BOIR. 

Email addresses and IP addresses may also be used for online social media remarketing. You consent to let us contact you via SMS and email in the future for reminders and related services to the BOIR. 

7. How information is disclosed

CTAboi.com exists to help customers submit reports to FinCEN. That means any information provided in a BOIR will by necessity be disclosed to FinCEN. Furthermore, information may be disclosed to other parties who are also classified as beneficial owners, company applicants, or third parties assisting with BOIR filing.

We do not intend to disclose any information to other parties except those complementary services. Your information will be available to others connected with your Reporting Company. It will also be available through subpoena and to cooperate with government agencies. 

FinCEN data by act of Congress is designed to be available to law enforcement, intelligence agencies, the internal revenue service, and other government agencies through access rules determined by government regulations. Likewise, Banks and other financial institutions will have access to your information should you provide your consent to them in order to comply with “know your customer” regulations. 

We may file for other Reporting Companies using information already entered for your Reporting Company if the information is the same.

8. Security practices

CTAboi takes security seriously. We have put into place administrative and technical measures in an effort to prevent your non-public information from being available to the general public unless disclosure of such is needed or without material harm to you. A level of encryption has been applied to aspects of our database. We cannot guarantee privacy or security as no security system is perfect, but we take reasonable steps to prevent a data breach.

We do not control FinCEN’s security of your information. 

9. Your rights under State Law

Non-customer users of the website and Beneficial Owners, Control Parties, Company Applicants, or third-party filers may have the right to:

  1. know about the personal information we collect about you and how it is used and shared;
  2. to delete personal information collected except what information has been filed with FinCEN or required for other compliance;
  3. opt-out of the sharing of your personal information except where required by law;
  4. non-discrimination for exercising their CCPA rights or applicable rights except where it would make the services futile;
  5. correct inaccurate personal information we have about you, including in the BOIR or updates to the BOIR through us without your knowledge; and
  6. limit the use and disclosure of sensitive personal information collected about you, except where required by law.

10. Your rights under GDPR

If you are a citizen within the European Union then under the General Data Protection Regulation you have certain rights. We process your personal data with your express consent when you sign up and it is necessary to fulfill our services under GDPR Art. 6. 

Your rights under GDPR include the following:

  5. The Right to Restriction of Processing
  6. The Right to Data Portability
  7. The Right to Object
  8. The Right to Avoid Automated Decision-Making

Please note that by using our services you expressly consent to our use of your sensitive data under GDPR Art. 9. Just as in the Schengen Euro-zone where beneficial ownership registries require PII, so also in the United states the “right to be forgotten” of individuals and their PII is curtailed by the compliance requirement to be reported and the need for the third party filer to maintain records. 

11. Changes to the policy

This Privacy Notice may be updated from time to time. We encourage you to regularly check back and review. We may notify you via email when an update has been made to this notice. By continuing to use our services you consent to our use of the privacy notice as it may be updated in the future.
